Terms of Service

Welcome to Sportfolio, a fantasy sports prediction and virtual trading platform operated by Sportfolio Technologies ("we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Sportfolio Technologies governing your access to and use of the Sportfolio web application, mobile application, and all associated services (the "Platform").

By registering an account, accessing, or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

By accessing or using the Sportfolio Platform, you expressly agree to these Terms. Your acceptance is indicated by any of the following actions:

• Clicking "I Agree," "Get Started," or any similar confirmation during registration
• Creating an account or logging into the Platform
• Accessing, browsing, or otherwise using any feature of the Platform
• Making a deposit, placing a trade, or submitting a prediction

These Terms apply to all users of the Platform, including registered members, guests, and any other individual who accesses or interacts with the Platform in any capacity. If you are accepting these Terms on behalf of a business or legal entity, you represent that you have the authority to bind that entity to these Terms.

To use the Sportfolio Platform, you must meet all of the following eligibility criteria:

By using the Platform, you represent and warrant that you meet all applicable eligibility requirements. We reserve the right to verify eligibility at any time and to suspend or terminate accounts that do not comply, without prior notice and without liability.

3.1 Registration Requirements

To access most features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration, including your real name, a valid email address, and an active phone number. You must keep this information updated at all times.

3.2 One Account Policy

Each individual person may only maintain one (1) active account on the Sportfolio Platform. Creating or operating multiple accounts, whether under the same or different names and identities, is a serious violation of these Terms and may result in permanent termination of all associated accounts and forfeiture of all balances.

3.3 Account Security

• You are solely responsible for maintaining the confidentiality of your account credentials, including your password, OTP codes, and any login methods.
• You are responsible for all activities that occur under your account, whether or not you authorized them.
• Account sharing — allowing any third party to access or operate your account — is strictly prohibited.
• You must notify us immediately at info@sportfolio.ng if you suspect unauthorized access to your account.
• Sportfolio Technologies will not be liable for any loss or damage arising from your failure to maintain account security.

3.4 Account Verification

We may require additional verification at any time to confirm your identity or protect the integrity of the Platform. Failure to cooperate with reasonable verification requests may result in temporary or permanent access restrictions.

4.1 Nature of the Platform

Sportfolio is a fantasy sports entertainment platform. All player and club shares available on the Platform are virtual assets that exist exclusively within the Sportfolio simulated market environment. They are not real securities, equities, financial instruments, or any form of real-world asset.

4.2 How Virtual Prices Work

Virtual asset prices on Sportfolio are determined by a combination of real-life football match performance data and the Platform's internal pricing algorithms. Events such as goals, assists, clean sheets, cards, wins, losses, and other match statistics influence virtual price movements. These mechanics are designed for entertainment and do not replicate or reflect any real financial market.

4.3 Platform Features

• Player & Club Shares: Buy and sell virtual shares of football players and clubs within the simulated marketplace.
• IPO Opportunities: Purchase virtual shares at discounted pre-launch prices before an asset opens for general trading. IPO shares are locked until the launch date.
• Indices: Trade grouped virtual assets representing a basket of players or clubs in a single position.
• Leverage Trading: Amplify your virtual position using 1x, 2x, 3x, or 5x leverage (10x available to Premium users for Indices). Higher leverage increases both potential gains and potential losses within the game.
• SPF Tokens: Earn in-platform reward tokens through trading activity. Token values and utility are determined solely by Sportfolio Technologies and are subject to change.

4.4 No Guaranteed Returns

Virtual asset values can increase or decrease. Past virtual asset performance does not guarantee or predict future results. Sportfolio Technologies does not promise or imply that any user will generate a profit from trading activity on the Platform.

5.1 Deposits

Users may fund their Sportfolio virtual wallet through our integrated payment processor (currently Korapay). Deposits are credited to your virtual wallet upon successful confirmation from the payment processor. The minimum deposit amount is ₦100. All prices and balances are denominated in Nigerian Naira (NGN).

5.2 Withdrawals

• Withdrawal requests are only processed after any open positions relating to the relevant balance have been fully closed.
• All withdrawal requests are subject to review and approval by Sportfolio Technologies before funds are disbursed.
• You must provide a valid Nigerian bank account in your own name to receive withdrawals.
• Identity verification (KYC) may be required before your first withdrawal or for amounts above a certain threshold.
• Withdrawal requests may be delayed or declined if we identify suspicious activity, incomplete verification, or a policy violation associated with your account.

5.3 Fees

Sportfolio Technologies may apply processing fees to deposits or withdrawals. Any applicable fees will be clearly disclosed to you before a transaction is confirmed. We reserve the right to revise fee structures with reasonable notice.

5.4 Payment Security

Sportfolio does not store your full payment card numbers, PINs, or CVV codes. All payment card data is handled exclusively by our regulated third-party payment processor. We are not responsible for errors or failures caused by the payment processor's systems.

To protect the integrity of the Platform and comply with applicable Nigerian regulations, Sportfolio Technologies may require you to complete a Know Your Customer (KYC) identity verification process.

6.1 When KYC Is Required

• Before your first withdrawal or when requesting a withdrawal above a threshold amount
• When suspicious activity is detected on your account
• When accessing premium account features or higher trade limits
• At any time we are required to do so under applicable law

6.2 Documents Required

• A clear image of a valid government-issued photo ID (NIN slip, Voter's Card, or Driver's License)
• A recent selfie or portrait photograph for identity matching
• Your National Identification Number (NIN) or Bank Verification Number (BVN) where required

6.3 KYC Failure & Consequences

If you fail to complete KYC when required, or if your submitted documents cannot be verified, we reserve the right to restrict your access to withdrawal and other financial features until verification is complete. Submitting fraudulent, altered, or stolen identity documents is a serious criminal offence and will result in immediate permanent account termination and referral to law enforcement.

7.1 Acceptable Use Policy

All users are expected to engage with the Sportfolio Platform responsibly and respectfully. As a member of the Sportfolio community, you agree to:

• Interact respectfully with other community members and with Sportfolio support staff at all times
• Keep all communication professional, free from harassment, threats, hate speech, or discrimination of any kind
• Report bugs, technical issues, or suspicious activity to support rather than exploiting them
• Uphold fair play and good sportsmanship in all platform interactions
• Use the Platform only for its intended entertainment purpose

7.2 Strictly Prohibited Activities

The following activities are strictly prohibited and will result in enforcement action:

7.3 Consequences of Violations

Sportfolio Technologies operates a graduated enforcement system. The severity of action taken will depend on the nature, frequency, and impact of the violation:

All content, features, and functionality of the Sportfolio Platform — including but not limited to the name "Sportfolio," all logos, branding, design elements, text, graphics, source code, software, algorithms, virtual market data, and the overall visual presentation — are owned exclusively by Sportfolio Technologies or its licensors and are protected by applicable Nigerian and international intellectual property laws.

8.1 License to Use

Subject to your compliance with these Terms, Sportfolio Technologies grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Platform solely for its intended personal entertainment purpose. This license does not include any right to modify, copy, distribute, reverse-engineer, or create derivative works based on the Platform.

8.2 Restrictions

• You must not copy, reproduce, distribute, or publicly display any part of the Platform without our prior written permission.
• You must not remove, alter, or obscure any copyright, trademark, or proprietary notices displayed on the Platform.
• You must not use Sportfolio's name, logo, or branding in any manner that suggests endorsement, partnership, or affiliation without our express written consent.
• You must not attempt to reverse-engineer, decompile, or extract the source code of any part of the Platform's software.

Your privacy is important to us. Our collection, use, storage, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference and forms part of this agreement. By accepting these Terms, you also accept our Privacy Policy.

Key points regarding your data on the Sportfolio Platform:

• Your personal data is stored securely on our servers and protected using encryption and access controls.
• We do not sell, rent, or trade your personal information to third parties for advertising or marketing purposes.
• Data may be shared with regulated third parties (e.g., payment processors) only as necessary to operate the Platform.
• You have rights to access, correct, and request deletion of your personal data. Contact info@sportfolio.ng to exercise these rights.

Sportfolio is an entertainment platform. The following disclaimers apply to all users:

• All player and club shares on the Platform are virtual assets with no connection to real financial markets, real stock exchanges, or real securities law.
• SPF tokens and any in-platform virtual currency are not cryptocurrencies, are not traded on any blockchain, and carry no guaranteed real-world monetary value.
• Sportfolio Technologies does not provide financial advice, investment recommendations, or trading signals. Nothing on the Platform should be interpreted as such.
• The Platform's pricing algorithms, market mechanics, and scoring systems are designed for entertainment and may be modified at any time at our sole discretion.
• Sportfolio Technologies reserves the right to adjust, correct, or reverse any virtual price movements, trade outcomes, or wallet credits that result from technical errors, pricing bugs, or exploitation of platform vulnerabilities.

To the maximum extent permitted by applicable Nigerian law, Sportfolio Technologies, its directors, employees, agents, and partners shall not be liable for:

• Any loss of virtual balance, portfolio value, or in-platform earnings arising from market movements, price algorithm changes, or match outcomes
• Indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Platform
• Loss of profits, data, or business opportunities resulting from Platform downtime, technical errors, or service interruptions
• Delays in withdrawal processing caused by payment processor failures, banking system outages, or verification requirements
• Actions or omissions of third-party service providers, including payment processors and data providers
• Platform unavailability due to maintenance, updates, or force majeure events beyond our reasonable control

Maximum Liability Cap

In the event Sportfolio Technologies is found liable despite the above, our total liability for any single claim or series of related claims shall not exceed the total deposit amount credited to your wallet in the 30 days preceding the event giving rise to the claim.

12.1 Termination by You

You may close your Sportfolio account at any time by contacting our support team at info@sportfolio.ng. Before closing, you should withdraw any available wallet balance. We reserve the right to withhold balances pending review if your account is under investigation at the time of the closure request.

12.2 Termination by Sportfolio Technologies

We reserve the right to suspend or permanently terminate any account, with or without prior notice, if we reasonably believe the account holder has:

• Violated any provision of these Terms or our Community Guidelines
• Created or operated multiple accounts
• Engaged in fraud, cheating, abuse, money laundering, or any illegal activity
• Provided false or fraudulent information during registration or KYC verification
• Posed a risk to the safety, integrity, or reputation of the Platform or its users
• Failed to complete required identity verification within a reasonable time

12.3 Effect of Termination

Upon termination, your license to use the Platform ends immediately. Sections of these Terms that by their nature should survive termination — including payment obligations, intellectual property rights, disclaimers, and limitations of liability — shall continue in full force after termination.

13.1 Informal Resolution First

We encourage you to contact us before pursuing any formal action. If you have a dispute with Sportfolio Technologies, please reach out to our support team at info@sportfolio.ng. We will make a good-faith effort to resolve your concern within 14 business days of receiving your complaint.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the competent courts of Lagos State, Nigeria.

13.3 No Class Actions

You agree that any dispute between you and Sportfolio Technologies will be resolved on an individual basis and not as part of a class action, consolidated action, or representative proceeding.

Sportfolio Technologies reserves the right to modify these Terms at any time to reflect changes in our services, operations, legal obligations, or business practices. When we make changes, we will:

• Update the Effective Date at the top of this page
• Send registered users an in-app notification or email for all material changes
• Provide at least 14 days' advance notice for changes that materially affect your rights or obligations

Your continued use of the Sportfolio Platform after revised Terms take effect constitutes your acceptance of the updated Terms. If you disagree with revised Terms, you must stop using the Platform and close your account before the changes take effect. The most current version of these Terms will always be accessible at sportfolio.ng/terms_of_service.php.
